Refund & Cancellation Policy

At Stack Nectar LLC, we provide custom software engineering, cloud architecture, and specialized web/mobile development services. Because our services involve the expenditure of non-recoverable time, labor, and technical resources by our senior engineering team, our refund policies differ from those of standard retail or SaaS products.
Please review this policy carefully before signing a Master Services Agreement (MSA) or Statement of Work (SOW) with our team.
1. General Policy Statement
All software development, architecture mapping, and UI/UX engineering services provided by Stack Nectar LLC are non-refundable once the work has been performed. We bill for developer time, technical expertise, and project management, which cannot be returned once expended.
2. Initial Deposits & Mobilization Fees
To commence any custom software project, Stack Nectar LLC typically requires an upfront mobilization deposit (usually ranging from 25% to 50% of the total project cost, or the first sprint fee, as defined in your SOW). This deposit covers initial system architecture, technical discovery, database mapping, and resource allocation.
Initial deposits are strictly non-refundable once the discovery and architecture phase has begun. If a client chooses to terminate the project before any actual coding has started, but after the discovery phase has commenced, the deposit is retained to cover the architectural labor expended.
3. Milestone & Sprint Payments
We operate on an Agile methodology. Projects are divided into functional milestones or sprints. Upon the successful delivery and client approval of a specific milestone, the payment for that milestone becomes fully non-refundable.
- If the Client discovers bugs or errors within an approved milestone, Stack Nectar LLC will patch and resolve these issues in accordance with our 30-day warranty policy (as outlined in our Terms and Conditions). Bugs do not constitute grounds for a refund.
4. Project Cancellation
Either party may cancel the project at any time, subject to the termination clauses in the signed MSA or SOW.
- Cancellation by Client: If the Client chooses to halt development mid-project, they are responsible for paying for all developer hours logged and technical resources consumed up to the date of written cancellation notice. Any unbilled hours will be invoiced, and any prepaid amounts exceeding the hours worked will be refunded to the Client within 30 business days.
- Cancellation by Stack Nectar LLC: We reserve the right to terminate a project if the Client is in breach of contract (e.g., failure to pay, refusal to communicate, hostile behavior). In such cases, the Client remains responsible for all work completed up to that point.
5. Post-Launch & DevOps Subscriptions
Any monthly retainer fees for DevOps, server maintenance, cloud hosting, or post-launch Service Level Agreements (SLAs) are non-refundable. Clients may cancel these recurring services with a standard 30-day written notice, but no prorated refunds will be issued for the current billing cycle.
6. Exceptions
Refunds are only issued under the following rare circumstance:
- Stack Nectar LLC completely fails to initiate the project or deliver the agreed-upon preliminary architecture within the timeframe specified in the SOW, and the delay is entirely the fault of Stack Nectar LLC (not caused by the Client’s failure to provide necessary assets or API access).
